In the video below, Linda Sauer of Montana Citizen’s Action Group lays out the details of the so called, “Protect Act” which was sponsored by Steve Daines in the Senate and co-sponsored by Ryan Zinke in the House. If passed, the legislation would greatly empower the Tribal Police to arrest and prosecute non-tribal members who commit crimes on any of Montana’s seven Indian reservations.
One specific aspect of the legislation that is most troubling is the ambiguity surrounding the allowance of a non-tribal suspect to have non-tribal legal defense counsel. In other words, any non-tribal member who is arrested will be at the mercy of the Tribal Police and may not even be able to have their own attorney come on to the Reservation to defend them in court.
