(Kalispell, MT) – Embattled landowner and CEO of Thorco Inc. Dennis Thornton recently filed a $50 million lawsuit against Flathead County, County Prosecutor Travis Ahner, and one current, and two former, assistant Flathead County prosecutors.
The suit is filed under 42 U.S.C. ; 1983, and alleges that those named in the suit maliciously prosecuted Thornton willfully, knowingly, and intentionally. Those named in the suit are as follows:
Flathead County
Travis Ahner (County Prosecutor)
Ashley Frechette (Assistant County Prosecutor)
Michael Noonan (Former Assistant County Prosecutor)
Angela Roland (Former Assistant County Prosecutor)
Although the complaint was filed at the Federal Court in Missoula a couple of weeks ago, NorthWest Liberty News only received verification of service from the process server earlier today.
One of the more compelling aspects of the Thornton lawsuit is that those named as defendants are being sued in both their professional & their personal capacity, which means that their personal estates are at risk of being liquidated if they are found guilty of the charges that Thornton alleges.
This is not the first time that a malicious prosecution charge against a BAR member in Flathead County has occurred, as Whitefish attorney Shawn Frampton was convicted of malicious prosecution against Deanna McAtee only a couple short years ago.
