It is no secret that the Montana Supreme Court (MSC) leans left. In fact, It’s arguably the most liberal SC of any “red” state in America. With the recent rulings on the release of e-mails in 2021 and the campus carry ruling in 2022, the MSC has established itself as the de facto ruler of the Treasure State, and it continues to usurp the will of the people’s representatives, even now, under the false assumption of “judicial supremacy.”

One fact that is commonly overlooked by pundits for and against the MSC is that they issue opinions, which do not need to be followed when they oppose the will of the people’s elected representatives. Simply put, what the MSC opines about can, and should, be ignored if it overturns a Montana law that has been enacted lawfully.
