One fact that is widely unknown by most men and women of Montana is that the Grand Jury process cannot be convened unless approved by a District Court Judge. The Montana Constitution covers it clearly in Article II, Section 20 (Seen Below).

The grassroots Montana Citizens Council on Judicial Accountability (MTSCOJA) hopes to change those circumstances with a ballot initiative that is intended to amend the Montana Constitution to allow the pursuit of justice to be put back into the hands of the men and women of Montana.

Before a ballot initiative can be considered valid and authorized to be included in the 2024 election, the Attorney General’s office must conduct a thorough review of the initiative to verify that it would withstand constitutional muster and does not “amount to regulatory taking.”

This seems like a good idea until you read to the bottom of the page and ask the question, “How will this be paid for?” Some people might want to use this as a harassment vehicle. Insiders (lawyers) might use it as a weapon for corrupt purposes. While I support the idea in principle as a way to combat corruption (and will probably vote for it, too) I think it needs more clarification. And if it’s used maliciously/corruptly what are the penalties for doing so? Who is paying for it, and how are they paying is important part of any legislation.
